Practice and procedure update: form updates

The Courts have updated the following forms:

The Application for Review forms have been separated for each jurisdiction. Prior to this time, there was one form used to file an application for review in either family law, general federal law or migration proceedings.

The Notice of Ceasing to Act form is used in family law proceedings. It has been updated to more closely align with the rule 3.10 of the Federal Circuit and Family Court of Australia (Family Law) Rules 2021. Practitioners must serve the form on their clients with Part A and Part B completed, and then complete Part C and Part D before lodging the form for filing.

Practitioners are reminded that they cannot file a Notice of Ceasing to Act within 14 days before the day fixed for a final hearing except with the leave of the court, which must be sought in writing.

The Financial Statement Kit and Financial Statement have had minor updates to instructions relating to service of completed Superannuation Information Forms.

The instructions page to the Superannuation Information Kit has been updated to reflect the requirement that the completed Superannuation Information Form is to be served on each other party.

The Application for Consent Orders has had minor changes to clarify requirements for signing the proposed orders by consent.

The template Balance Sheet has been updated to remove reference to addbacks.

A grace period for the use of the old versions of the forms will expire at close of filing on Friday, 30 January 2026.
