The Courts have updated the following forms:
- Response to Initiating Application
- Undertaking
- Third Party Debt Notice
- Enforcement Warrant
- Affidavit: Translation of Marriage Certificate
- Notice of Address for Service
The Response to Initiating Application has been updated at Part B. This includes an additional question for a Respondent seeking parenting orders where parenting orders had not been sought by the Applicant, updates to headings and additional instructions. There have been associated changes to the instruction pages in the Response to Initiating Application Kit.
The Undertaking has been updated to include a witness requirement. This is consistent with the Undertaking as to disclosure.
The Third Party Debt Notice and Enforcement Warrant have been updated to include reference to the Federal Circuit and Family Court of Australia (Division 2) (Family Law) Rules 2021 where applicable.
The Affidavit: Translation of Marriage Certificate has been updated to include an instruction page as well as some terminology updates in the form.
The Notice of Address for Service has been updated to include an additional instruction for Independent Children’s Lawyers completing the form.
Early copies of the forms are being provided to assist the profession and the public to become familiar with the changes. These versions of the forms should not be filed until 28 March 2026.
The updated forms will be published for use on the forms page of the Courts’ website on 28 March 2026.
A grace period for the use of the old versions of the forms will expire at close of filing on 17 April 2026.
