      The Federal Circuit and Family Court of Australia (the FCFCOA) values the privacy of everyone whose information it holds. This Privacy Policy informs you of the FCFCOA’s approach to the protection of the personal information it holds, including how it secures and uses it, your rights to see it and the ways you may obtain further help. This Privacy Policy is intended to comply with the Privacy Act 1988 (the Privacy Act).

      This brochure summarises what Court staff can and cannot provide or do
    • Subpoena: Information for named person or other person (served with a subpoena or a copy of a subpoena) (prescribed brochure)

      This brochure is for people who have been served with: A subpoena, and who are required to comply with the subpoena (named person), or; A copy of a subpoena as a party or interested person, and who may want to object to the inspecting or copying of a document/s to be produced in compliance with the subpoena. It provides information about the use of, and compliance with, subpoenas in the Federal Circuit and Family Court of Australia (the Court).

    • Transfer of proceedings

      All family law matters must be commenced in the Federal Circuit and Family Court of Australia (Division 2). More complex matters that are filed in Division 2 can be transferred to the Federal Circuit and Family Court of Australia (Division 1) or in some cases the Federal Court of Australia (whichever has jurisdiction). Similarly, there are provisions to transfer less complex matters from other courts to the Federal Circuit and Family Court of Australia (Division 2).
    • Media release: Launch of a new National Contravention List to tackle issues of non-compliance with court orders in family law cases

      To address a long-standing issue of non-compliance with court orders that are made in family law proceedings in the Family Court of Australia and the Federal Circuit Court of Australia, the Courts have created a dedicated national electronic court list that will deal, consistently and responsively, with contravention applications. Applications will be given a first return court date within 14 days of filing
    • Affidavit of service by hand (divorce)

      This form is used by a person filing a sole application for divorce who is arranging service of the divorce application on their spouse by hand.
