  • Practice and procedure update: Family Law Rules

    Today the Courts are providing an update in relation to amendments to the Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Family Law Rules). The Family Law Rules have been amended by the passage of the Federal Circuit and Family Court of Australia (Family Law) Amendment (2024 Measures No.1) Rules 2024 which has been approved by a majority of Judges.   • Family Law Practice Direction: Surrogacy proceedings

    This Practice Direction applies to applications for parenting orders filed in the Federal Circuit and Family Court of Australia in relation to a child born under a surrogacy arrangement, whether such arrangement is recognised under the laws of a State of Australia or otherwise. It does not apply to surrogacy proceedings where final parenting orders under Part VII of the Family Law Act 1975 have already been made in relation to the child.

    This Practice Direction establishes the pilot of a Major Complex Financial Proceedings List, which applies to any Initiating Application (Family Law) seeking financial or property orders pursuant to the Family Law Act 1975, that is a Major Complex Financial Proceedings List case (MCFP List Case) in the Melbourne, Sydney or Brisbane registry or if appropriate to be managed electronically, a MCFP List Case in any other registry of the Court. The pilot of the MCFP List commenced on 1 October 2021.
