    Unless the Court excuses you from attending, you must attend court whenever there is a hearing. If you do not attend the Court hearing and do not have a lawyer appearing for you, the Court might dismiss your application in your absence and order you to pay the Minister’s costs.

  • Family Law Practice Direction: Appeals

    This Practice Direction sets out the procedure for all family law appeals and applications for leave to appeal from a judgment of a judge of the Federal Circuit and Family Court of Australia exercising the original jurisdiction of the Court; a single judge of a Supreme Court of a State or Territory exercising the original jurisdiction of the Court; or a family law Magistrate of Western Australia.

  • FCFCOA Practice Direction – Revocation of Practice Directions and Information Notices

    The Federal Circuit and Family Court of Australia has developed new rules of court for all proceedings in the Court with effect from 1 September 2021. Various new Practice Directions and Information Notices have been issued to accompany the new rules. This Practice Direction formally revokes a number of outdated or superseded Practice Directions and Information Notices issued by the Family Court of Australia or Federal Circuit Court of Australia prior to the commencement of the operation of the Court on 1 September 2021.

    How does the law treat superannuation? The superannuation splitting law treats superannuation as a different type of property. It lets separating couples value their superannuation and split superannuation payments, although this is not mandatory. Splitting does not convert superannuation into a cash asset – it is still subject to superannuation laws (for example, it is usually retained until retirement ages are reached).

  • Media release: Therapy Dog Poppy's 'woof of honour' as she is sworn into the Court

    The Federal Circuit and Family Court of Australia (the Courts) have today launched the Court Dog Program. Thanks to the support and generosity of the Victorian Bar and the Victorian Bar Foundation, Therapy Dog Poppy, a fully trained court facility dog from Guide Dogs Victoria, will commence full time work with the Courts from the 4th of October by assisting litigants and children who are involved in family law proceedings in the Courts' Melbourne registry.
