This form is used by a party in a migration or general federal law proceeding to ask the Court to issue a subpoena. A subpoena is a legal document issued by the Court.

This Information Notice applies to all proceedings filed in the Federal Circuit and Family Court of Australia (Division 1) and (Division 2) (Courts) in the Courts’ family law, migration and general federal law jurisdictions.

The Family Violence Plan (the Plan) reflects the ongoing commitment by both Courts to the early identification and management of matters where violence or the risk of violence is alleged, and to keeping all court users safe. It is an overarching document setting out important actions to be undertaken by the Courts to ensure best practice in all areas of administration, operation and application of the law. It covers areas as diverse as building layout, security screening, risk assessment, safety planning for individual litigants as well as education and training of staff and the judiciary. The Plan sets out three priority areas, each of which has defined goals, identified actions and timelines.

This Practice Direction applies to family law applications meeting the criteria set out in this Practice Direction and filed in the Federal Circuit and Family Court of Australia (the Court)

The purpose of the List is to ensure compliance with the relevant Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Family Law Rules) and any case management orders and directions made by a Registrar in family law or child support proceedings, in accordance with the overarching purpose of family law practice and procedure. The Defaulters’ List will initially be piloted in the Sydney Registry of the Courts with a view to expansion if successful.
