A National Enforcement List will commence in the Courts' family law jurisdiction on 21 September 2026.
The National Enforcement List will provide for a streamlined process for:
- enforcement applications; and
- enforcement requests dealt with in Chambers, including requests for a Registrar to sign documents pursuant to section 106A of the Family Law Act 1975 or for a Third Party Debt Notice or Warrant for Seizure and Sale of Property to be issued.
From 21 September, all enforcement applications and enforcement requests are to be lodged for filing by email to enforcementlist@fcfcoa.gov.au, together with any required supporting documents.
The National Enforcement List has been designed to:
- uphold the authority of the Court by enforcing compliance with orders;
- efficiently deal with applications for enforcement on a national basis in a timely, cost effective and safe way for all litigants;
- deter non-compliance with orders;
- where appropriate, resolve difficulties with financial or property orders which have contributed to non-compliance;
- impose appropriate costs orders where enforcement orders are required to be made; and
- triage appropriate matters to dispute resolution.
Family Law Practice Direction – National Enforcement List
The Family Law Practice Direction – National Enforcement List has now been issued.
Practitioners should familiarise themselves with the case management of all enforcement applications and enforcement requests prior to 21 September 2026.
