Notice of contention – General Federal Law

This form is used by the respondent/s named in:

  • An appeal from the Administrative Review Tribunal transferred to the Court from the Federal Court (see Part 27 of the Rules);
  • An appeal from a decision of the Commissioner (see Part 30 of the Rules)

This form is filed by the Respondent if they do not want to cross-appeal from any part of the decision, but contend that the decision should be affirmed on grounds other than those relied on by the Tribunal or Commissioner.

Filing with the Court

Wherever possible, you must file court documents commencing or relevant to a matter online using eLodgment. See the Federal Court website for information on how to use eLodgment.

If it is not possible to file using eLodgment, you may be able to file your documents in-person, by mail, or in certain circumstances, by fax or email. Contact the Court if you are not sure how to file the documents.

Service

The Notice of Contention must be filed within 21 days after the Notice of Appeal was served on the Respondent and served on any other parties by ordinary service.
